SLC concludes workshop on ‘The Legislative Audit Transparency Standards’

The Supreme Legislation Committee in the Emirate of Dubai (SLC) successfully concluded its workshop titled ‘The Legislative Audit Transparency Standards’, in which senior officials representing 24 Dubai Government entities actively participated. The workshop is one of the SLC initiatives to enhance effective communication with government entities, with a view to strengthening the SLC Legislative Audit Directorate’s role in reviewing and developing legislation; ensuring the proper implementation of legislation in accordance with international best practices; and verifying that the provisions of all legislation are consistent with applicable local and federal legislation. This is in implementation of the Dubai Plan 2021 objective; namely, to build a pioneering, transparent, and reliable government that ensures fair and reliable implementation of legislation to protect the rights of individuals and institutions in the emirate.

Ahmad bin Meshar, SLC Secretary General, said: “Hosting the workshop confirms the SLC’s commitment to concert and channel the efforts of government legal officers towards creating a transparent and fair legislative system in Dubai. In ensuring proper implementation of legislation, the SLC General Secretariat adopts transparency, which is the approach adopted by the Dubai Government in its policies, legislation, services, and activities, with the ultimate objective of creating a competent and reliable government. This is in line with the insightful vision of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai-  may Allah keep him safe- who aims to transform the government into a government that serves, not compels, the people.”

Bin Meshar added:”We will continue to strengthen our cooperation with the government entities concerned with legislative audit in Dubai as we believe that joint efforts are key to creating a distinguished legal environment, based on pioneering legislation, and supported by sound and effective legal opinions. The recently concluded workshop has underscored the role of government entities in effectively implementing the legislation applicable to them. This will create synergy among policies, strategies, and legislation in line with the Dubai Plan 2021, which aims to develop a pioneering, distinguished, and proactive government that is capable of meeting present needs and looking ahead to future challenges. We look forward to continuing our efforts to enhance the legislative process and the legal system in Dubai through proper implementation of legislation, which is one of the most important strategic objectives of the SLC.”

The workshop was facilitated by legal officers from a number of the SLC directorates, who touched upon the best legislative practices. The workshop focused on three main themes, first among which was entitled ‘Regulatory Impact Analysis (RIA) as a Means of Achieving Legislative Transparency’. Under this theme, the great significance of RIA was underscored; being a key instrument for issuing effective legislation and facilitating the legislative audit processes. Adopting the RIA approach ensures that a government entity is compliant with the applicable legislation in respect of the procedures it follows, the functions it exercises, and the obligations it imposes on its customers. In addition, RIA ensures legislative transparency as it requires gauging the opinions of stakeholders in respect of proposed legislation or legislative amendments, through effective communication channels.

The topic tackled under the second theme was ‘Publication in the Official Gazette, the obligation to Publish Legislation in the Official Gazette, and the Legal Effects of this Publication’. Participants were briefed on the key provisions of the law regulating publication in the Government of Dubai Official Gazette.

The third and final part of the workshop was entitled ‘A Practical Exercise on Preparing Legislative Audit Report’, which is an important tool for continued improvement of organisational legislative performance as it enables the officials in charge of government entities to follow up on the proper implementation of the applicable legislation in force in the emirate. Participants have been given one-on-one training on how to identify the resolutions that must be published in the Official Gazette.
